В конце июля Арбитражный суд Москвы утвердил мировое соглашение между компанией Philip Morris Products SA (Швейцария) и Тверским региональным общественным фондом "Мальборо". Первоначально истец Philip Morris Products SA, заявивший о нарушении прав на использование товарного знака, требовал запретить фонду "Мальборо" использовать домен marlboro.ru и передать истцу право на администрирование домена.

В конце июля на утверждение суда было представлено мировое соглашение, подписанное полномочными представителями истца и ответчика, присутствующими в заседании. Изучив содержание мирового соглашения, суд пришел к выводу, что оно заключено на взаимоприемлемых условиях, не противоречит закону, не нарушает права и законные интересы других лиц, направлено на прекращение спора мирным путем.

В соответствии с указанным соглашением Фонд, являясь администратором домена marlboro.ru, передал домен компании Philip Morris Products SA, которая должна была уплатить Фонду денежную сумму в размере 280 тыс. рублей. А 2 тыс. рублей были взысканы с Тверского регионального общественного фонда "Мальборо" в пользу компании Philip Morris Products SA в качестве госпошлины.


At the end of July the Arbitration court of Moscow has ratified the agreement of lawsuit between company Philip Morris Products SA (Switzerland) and Tver regional public fund " Мальборо ". Originally claimant Philip Morris Products SA declared infringement of rights of use of a trade mark, demanded to forbid to fund " Мальборо " to use the domain marlboro.ru and to transfer the claimant the right to administration of the domain.

At the end of July on the statement of court the agreement of lawsuit signed by plenipotentiaries of the claimant and the respondent, present in session has been submitted. Having studied the maintenance(contents) of the agreement of lawsuit, the court has come to a conclusion, that it is made on mutually acceptable conditions, does not contradict the law, does not break the right and legitimate interests of other persons, is directed on the termination(discontinuance) of dispute by peace way.

According to the specified agreement the Fund, being the manager of the domain marlboro.ru, has transferred the domain of company Philip Morris Products SA which should pay to Fund a sum of money at a rate of 280 thousand roubles. And by 2 thousand roubles have been collected from Tver regional public fund " Мальборо " for the benefit of company Philip Morris Products SA as the state duty.
